GENERAL TERMS & CONDITIONS

These terms and conditions govern the relationship between the traveller and Afrika's Best Tours (ABT).

1. Tour booking

By sending us your booking you make us a binding offer to the completion of a travelling contract. The booking can take place in written or oral/electronic form (e.g. e-mail). The booking for a tour is completed by the person booking for all people listed for the tour.


2. Travelling contract

The person booking obliges him– or herself and all listed persons to complete the conditions of the contract . The contract comes into effect when ABT accepts it. If ABT is not capable of providing accomodation for the client in one or more of the hotels listed in the tour description the client is provided with accomodation in an equivalent hotel.


3. Payment

On completion of the contract each person has to pay 30% of the final price. The final payment has to be made at least 30 days before beginning the tour (receipt of payment at ABT).


4. Withdrawal or change of the tour by the client

Withdrawal from the contract has to be in written form. Decisive is the time of receipt of the declaration of the withdrawal from the contract at ABT. The Tour Operator can make a claim for compensation for the expenditures made at the time of the withdrawal:
Withdrawal up to the 30. Day before tour begin – 30% of the tour cost
Withdrawal between the 29. and 15. Day before tour begin – 50% of the tour cost
Withdrawal between the 14. Day and tour begin – 100% of the tour cost

Change of booking in terms of time can be accomodated if possible for a fee of € 60,– per person. If any costs by a third party arise these will be forwarded to the client.

Up until tour begin the client can let another person take his/her place. If any cost arises through this the client will be charged with them.


5. Withdrawal or termination by the tour operator

ABT can withdraw from the contract if the tour cannot take place after use of all possible ressources. These circumstances have to be proven to the client. In such a case the client will receive the payed amount back.


6. Liability

The contractural liability by the tour operator is limited to double the tour cost. External services by third parties are excluded from this. Claims must be made within one week after ending the tour in written form, after the first week claims can only be made if the client was hindered without own fault. The claims are limited to 6 months after the contractural end of the tour.
The traveller is responsible for abiding all rules and regulations necessary to conduct the tour. The client is responsible for any disadvantages caused by not abiding to these rules and regulations.


7. Area of jurisdication

The traveller can only sue the tour operator at it's headquarters. The tour operator can only sue the traveller at his/her home court.
